Legal tech company Legion is suing the Trump admin over the forced shutdown of Anthropic’s Fable 5 and Mythos 5 for foreign nationals. The core argument is the following: Access to a hosted AI model is not the same as exporting model weights, source code, or technical data. As the lawsuit puts it: “Commerce cannot enforce a control that does not exist.” And even more directly: “The user receives only inferential text output.” The complaint also attacks the government’s rationale. The alleged risk was that Fable 5 could review software code and identify flaws. Legion’s response: “In other words, a typical use of nearly every flagship LLM.” That’s the real question now: Can the US government treat hosted frontier AI access as an export-controlled technology, even when users only receive text outputs? If courts say yes, Washington gets a powerful lever to switch off frontier models globally. If courts say no, the government may need a new legal framework for AI model access.
